How much do lawyers cost?
Lawyers rates vary based on their experience and level of expertise. Most family law attorneys charge by the hour in 1/10th of an hour increments. Average rates can be as low as $200.00 per hour or as high as $600.00 per hour. Lawyers also generally charge a retainer which is an initial payment needed to secure the services of the lawyer. Can the other side be forced to pay my fees?
Sometimes. In certain cases the judge can review the finances of the parties and the reasonableness of each party's position and order one party to pay all or part of the other's litigation expenses. Most lawyers will insist that you pay for your lawyer and if the Court makes the other side pay, then you will be reimbursed when the other side actually pays, as long as you are current on your balance with your lawyer.

What can make the price increase?
Complex issues such as the division of a business or a complicated custody arrangement can cause fees to increase. Generally, anything which requires more of the lawyer's time will cause fees to be higher.

How can I keep costs down?
Do your homework. Organize your information for your attorney including income and asset statements. Use a form such as the and anything else which simplifies your situation.

What if my case is "uncontested"?
If you present an attorney with all the terms of an agreement you and the other side have worked out, an attorney may prepare the case for a flat fee. This means that you will pay one set amount and your case will cost no more, unless one party backs out of the agreement.

What are "Court costs"?
"Court costs" are costs charged by the court to file a case. They are usually about $100.00. There may also be costs for a sheriff to serve the papers which may be $25.00 or more.
